1. General
These Terms & Conditions govern all orders placed with BERRY AND BLOOM. By placing an order through our website or any other platform, you agree to be bound by the following terms. We reserve the right to update or modify these terms at any time without prior notice. It is your responsibility to review them periodically.
2. Nature of Products
All our creations are handmade, perishable, and often custom-designed. Due to the artisanal nature of our work, slight variations in appearance may occur. We do not guarantee exact duplication of any image or previous creation.
3. Orders & Payment

Orders must be placed at least 3 business days in advance, with 1–2 weeks’ notice preferred for large or custom orders.

Orders are confirmed only upon full payment or a non-refundable deposit (if applicable).

Pricing is subject to change and may vary depending on availability of ingredients, season, and customization.
4. Cancellations & Refunds
Due to the custom and perishable nature of our products:

All sales are final.

We do not accept returns, exchanges, or cancellations after payment is processed.

If an order must be cancelled due to unforeseen circumstances, please contact us at least 72 hours in advance, and we may, at our sole discretion, offer a partial credit for future use.
5. Delivery & Pick-Up

Deliveries are made within specific areas and time frames. You are responsible for providing the correct delivery address and contact information.

We are not liable for issues arising from incorrect addresses, missed deliveries due to absence, or changes not communicated at least 48 hours in advance.

Once delivered or picked up, the product becomes the full responsibility of the Client.
6. Allergens & Dietary Restrictions
While we offer gluten-free, vegan, and no-sugar-added options, our products are made in a facility that processes nuts, dairy, and gluten. We cannot guarantee the absence of trace allergens.
7. Product Handling
Our products are temperature-sensitive and should be kept cool and consumed the same day for optimal quality. We are not responsible for damage caused by improper storage after delivery.
8. Limitation of Liability
To the fullest extent permitted by law:

Our liability is limited to the amount paid for the order in question.

We are not responsible for indirect, incidental, or consequential damages of any kind, including lost profits, missed events, or emotional distress.
9. Intellectual Property
All content, designs, images, and creations remain the intellectual property of BERRY AND BLOOM. Unauthorized use or reproduction is strictly prohibited.
10. Client Communication
We reserve the right to refuse service to anyone engaging in disrespectful, dishonest, or abusive behavior. Communication must remain professional at all times.
11. Force Majeure
We are not liable for delays or cancellations caused by events beyond our control, including but not limited to natural disasters, power outages, illness, or transportation disruptions.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California, United States.
